Wildhorse Resort & Casino SMS Text to Win Promotions (Wildhorse Text to Win) are intended for viewing and submission of entry forms in the United States only (including its territories, possessions, and commonwealths, except Puerto Rico), excluding the states of Florida, New York and Rhode Island and will be construed and evaluated according to United States laws. 1. Introduction
This casino, located in Oregon, is owned and operated by the Confederated Tribes of the Umatilla Indian Reservation, DBA Wildhorse Resort & Casino 46510 Wildhorse Blvd, Pendleton, Oregon 97801(“WRC”). WRC is offering games of chance (“Games”) to promote its casino/hotel offers and/or other WRC promotional offers via email, mail and text.
2. How to Play
Participants are entered in the Wildhorse Text to Win by registering through text at 99158. Multiple keywords may be used during the promotional period. Participants enter via Text reply. At the time of registration, participants will have the opportunity to “opt-in” to receive promotional email and/or text offers from WRC. Participants may opt-out at any time by clicking on the “unsubscribe” link that appears in all promotional emails. Participants may opt-out of text messaging or get more information by texting to 99158 either STOP to end, and HELP for help. No purchase or entry fee is required. The Wildhorse Text to Win promotions are offered through Wildhorse Resort & Casino. Participants must fill out the required fields on the text, email, or form to be entered into a random drawing (collectively “Eligible Entries”). There will be a predetermined number of winners selected from all of the Eligible Entries received, at a date and time identified in the Official Rules per each Wildhorse Text to Win promotion. Participants must complete all required data requested on the entry form. Incomplete or inaccurate entry forms are void. First or last name initials are not permitted. Multiple entries of the same Text phone number are not permitted per game. Limit one (1) entry per person per text, per game. Participant may enter again on other Wildhorse Text to Win promotions. By entering, participants acknowledge compliance with these official rules including all eligibility requirements. Use of automated devices to enter the Wildhorse Text to Win promotions is prohibited. WRC, its affiliates and any partners in Games including promotion, fulfillment, and advertising agencies are not responsible for any problems or technical malfunctions of any telephone network or lines, computer on-line systems, servers or providers, computer equipment, software, failure of email or players on account of technical problems or traffic congestion on the Internet or at any web site or combination thereof, including injury or damage to participants or to any other person’s computer related to or resulting from participating or downloading materials in this Wildhorse Text to Win promotion. If, for any reason, the Wildhorse Text to Win promotion is not capable of running as planned, including infection by computer virus, bugs, tampering, unauthorized intervention, fraud, technical failures, or any other causes beyond the control of WRC which corrupt or affect the administration, security, fairness, integrity or proper conduct of Wildhorse Text to Win promotion(s) or for any reason WRC deems it necessary, WRC reserves the right at its sole discretion to cancel, terminate, modify or suspend the Wildhorse Text to Win promotion. WRC is not responsible for lost, late, incomplete, invalid, illegible, or misdirected entries, which will be disqualified; for failed, partial or garbled computer transmissions; for technical failures of any kind, including, but not limited to electronic malfunctioning of any network, hardware or software; or for any error, human, technical or otherwise.
3. How to Win
The Prize Winner(s) will be chosen from among all of the Eligible Entries received, by a random electronic drawing on the date specified in the promotions Official Rules. The selected Prize Winner for each Game will be contacted by text only and asked to contact Wildhorse via the email and/or phone address provided to them at time of notification of winning. The Prize is subject to the SMS Text to Win Promotions General Terms & Conditions and as set forth in the Official Rules per each Wildhorse Text to Win promotion. Entry to Wildhorse Text to Win promotion(s) is valid for the duration of each specific Game, the timing of which is set forth in the Official Rules per each Game. Odds of winning depend on the total number of Eligible Entries received each game day.
4. Timing
The Wildhorse Resort & Casino Wildhorse SMS Text to Win Promotions begins as outlined in the Official Rules per each Game.
5. Claiming Prizes
No substitution of prize, transfer of prize or cash alternative permitted, except by WRC due to prize unavailability at time of award in which case a prize of equal or greater value may be awarded. Unless specified otherwise by WRC, no cash will be awarded. If the prize or prize notification is returned as undeliverable, the prize is forfeited. Winners may have to sign an affidavit of eligibility and release of WRC and its affiliates, including but not limited to its partners in the Game, prize providers, and its promotion, fulfillment, and advertising agencies, from any and all liability, claims, demands, and causes of action for personal injury and/or damage, theft, or loss suffered in connection with this promotion or the use or acceptance of the prize or any portion thereof to be eligible for the prize; and where permitted, a promotional release granting the right to use his or her name and likenesses for advertising and publicity purposes without additional compensation. The receipt by any winner of any of the prize components of Wildhorse Text to Win promotions are conditioned upon compliance with any and all federal, state and local rules and regulations. ANY VIOLATION OF THESE GENERAL TERMS & CONDITIONS OR THE OFFICIAL RULES BY ANY WINNER (AT WRC’S SOLE DISCRETION) WILL RESULT IN SUCH WINNER’S DISQUALIFICATION AS WINNER OF THE GAME AND ALL PRIVILEGES AS WINNER WILL BE IMMEDIATELY TERMINATED.
The value of the prize may be taxable as income. Upon receipt of the prize, the winner(s) may be required to comply with any and all applicable federal, state and local taxes that become due with respect to the prize. The winner may be required to fill out a 1099, sign a press release, provide a photocopy of valid photo identification and provide either a photocopy of their social security card or fill out a W9 form.
6. Prize and Odds
The prizes and values of prizes are provided in the Official Rules per each Wildhorse Text to Win promotion. Prizes must be claimed by signing prize form prior to receiving prize. Prizes based on availability. Blackout dates apply. Management reserves all rights to cancel or modify promotion(s) at any time. WRC encourages responsible gaming. No cash or other substitutions permitted, except by WRC, who reserves the right to substitute any Prize with another prize of equal or greater value in the event of unavailability. The odds for winning the Prize depend on the total number of Eligible Entries in the Game.
7. Who is Eligible
The Wildhorse Text to Win promotions are open only to United States residents, (excluding residents of the states of Florida, New York, and Rhode Island) who are 21 years of age or older. Employees of Wildhorse Resort & Casino, WRC, its subsidiaries, affiliates, agents, and prize providers and their immediate family (defined as parents, children, siblings, husband, wife, or life partner) of each such employee, together with those with whom such employees are domiciled, are not eligible.
To claim prizes, you must present a valid driver’s license and/or other government issued ID for proof of legal age and residence. Winners are solely responsible for taxes on any winnings associated with the Game.
8. Terms and Conditions
Except where prohibited by law, including but not limited to the states of New York, Florida, Rhode Island and locations outside of the United States, participation in the Game constitutes winner(s) consent to WRC and any prize provider’s use of the winner’s name, city, state, and county, likeness, photograph, statements made by the winner about the Game, WRC prize providers or prize information for promotional purposes in any media without further payment or consideration. All entries will be deemed made by the authorized account holder of the mobile phone number submitted at the time of entry, and any potential winner may be required to show proof of being the authorized account holder for that mobile phone number. The “authorized account holder” is the natural person assigned to an mobile phone number address by a mobile phone service provider, online service provider, or other organization responsible for assigning mobile phone numbers. By receipt of any prize, the winner agrees to release and hold harmless WRC, its related companies, and its officers, directors, employees and agents and its partners in this Game including prize providers, promotion, fulfillment, and advertising agencies and prize providers from and against any claim or cause of action arising out of participation in the Game or receipt or use of the prize. All entries become the property of WRC, and none will be returned.
All interpretations of the rules and decisions by WRC are final. WRC reserves the right at its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Game, SMS text messaging platform, or WRC web sites; to be acting in violation of these official rules; or to be acting in an unsportsmanlike or disruptive manner, or with intent to annoy, abuse, threaten or harass any other person. CAUTION: ANY ATTEMPT BY A PARTICIPANT OR ANY OTHER INDIVIDUAL TO DELIBERATELY DAMAGE ANY SMS TEXT MESSAGING PLATFORM, WEB SITE, OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, WRC RESERVES THE RIGHT TO SEEK DAMAGES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
9. Winning mobile phone numbers per each Game will be provided to WRC’s players’ club – Club Wild. Club Wild staff will validate each winner using valid photo ID, and then award prizes as laid out in the official rules for that Game.
10. Winner agrees that WRC, its subsidiaries, affiliates, related companies, employees, its partners in this Game including prize providers, promotion, fulfillment, and advertising agencies and their subsidiaries, affiliates, related companies and employees shall have no liability in connection with acceptance or use of any of the prizes awarded herein.
